Disabled Workers and Sick Leave with the Legal Advice Centre

It’s natural for employers to be concerned about balancing their organisational needs with their legal obligations regarding sickness absence. Even if you have a set of clear policies and procedures for absences, it’s not always best practice and can often disadvantage Disabled workers and/or those with long-term health conditions.

Some of the things that this workshop will explain include:

– Your obligations as an employer under the law, including Statutory Sick Pay (SSP), fit notes and time off to help dependents.
– How to distinguish between disability and non-disability related sickness absence.
– How to manage both intermittent and long-term sickness absence, including when an employee needs to get a fit note, how and when to keep in touch, and how to keep track of absences.
– How to support Disabled workers back into the workplace with a phased return and reasonable adjustments.
– What the law says about dismissing a Disabled worker for sickness absence.

Our host, Elizabeth Davey (she/her), brings over a decade of legal experience and knowledge to our spring series of workshops with the Legal Advice Centre. Elizabeth is the Project Director and a solicitor at the Legal Advice Centre specialising in employment and discrimination law. Elizabeth has also been a solicitor at the Equality and Human Rights Commission where she set up and managed the Access to Justice project focussing on discrimination in education.
